3. Financial Market Data

Finage offers access to a diverse array of financial market data ("Market Data"), designed to support your personal analysis and understanding of various financial markets. This section clarifies the nature, sources, and limitations of the Market Data provided through our services and on our website.

3.1 Nature and Source of Data • Data Accuracy and Timeliness: Please be aware that all data provided by Finage, including but not limited to the prices displayed on ticker and charts pages, are not guaranteed to be real-time or accurate. The Market Data is intended strictly for informational purposes and should not be the sole basis for any investing or trading decisions. • Non-Exchange Sources: The Market Data provided by Finage is not sourced directly or indirectly from formal exchanges. Instead, our data compilation efforts focus on over-the-counter transactions, peer-to-peer networks, and market makers. This approach means that the prices and data we provide may not align with the actual market prices and could significantly differ from what is reported on formal exchanges.

3.2 Use of Market Data • Informational Purposes Only: The Market Data is provided to aid your personal financial education and decision-making process. It is crucial to conduct your own research and consider multiple data sources before making any investment or trading decisions. • Redistribution Prohibited: Redistribution of any information displayed on or provided by Finage, including data found on our website, through our APIs, or any other means, is strictly prohibited without express written permission from Finage.

3.3 Liability and Responsibility • Disclaimer of Liability: Finage expressly disclaims liability for any trading or investing losses you may incur as a result of using the Market Data. The nature of financial markets means that there is always a risk involved in trading and investing decisions, and market prices can be volatile. • User Responsibility: By accessing our website and using our services, you accept all responsibility for any risks involved in your financial decisions. It is your duty to evaluate the accuracy, completeness, and usefulness of any Market Data

provided by Finage. Finage will not accept liability for losses or damages arising from the use of our data or related services.

3.4 Acceptance of Terms • Acknowledgment of Conditions: By accessing our website or using our services, all users/visitors are deemed to have acknowledged and accepted the above conditions regarding the Market Data. Your use of Finage's services signifies your agreement to these terms and an understanding of the nature of the data we provide.

4. Intellectual Property Rights

At Finage, we take the protection of intellectual property very seriously, recognizing it as a cornerstone of our value proposition to users and partners alike. This section outlines the intellectual property rights associated with the Services, including the Market Data, software, and any content provided by Finage.

Unauthorized use of any Finage content or data without express written permission is strictly prohibited.

4.2 Use of Finage Content • License to Use: Subject to your compliance with these Terms, Finage grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and the content provided through the Services for your personal, non- commercial use. This license is solely for the purpose of enabling you to use and enjoy the benefit of the Services as provided by Finage, in the manner permitted by these Terms. • Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Services or the content included, nor may you reverse engineer or attempt to extract the source code of any part of our Services, except as laws prohibit these restrictions or you have our written permission.

4.3 Trademarks • Finage Trademarks: The Finage name, the Finage logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Finage or its affiliates or licensors. 4.4 Intellectual Property Infringement • Reporting Infringement: Finage respects the intellectual property rights of others and expects its users to do the same. If you believe that your copyright, trademark, or other intellectual property rights have been infringed by content on Finage's Services, please notify us with a comprehensive description of the alleged infringement. By accessing or using Finage's Services, you acknowledge and agree that the intellectual property rights in the Services and their content are critical assets of Finage and its data providers. You commit to respecting these rights and to using the Services and

their content within the bounds of the license granted under these Terms.

8. Arbitration and Dispute Resolution

8.1 Agreement to Arbitrate You and Finage agree that any dispute, claim, or controversy arising out of or in connection to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in United Kingdom, before one arbitrator. The arbitration shall be administered by [Arbitration Association] pursuant to its Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction.

8.2 Arbitration Rules • Initiation of Arbitration: To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent. The arbitration will be conducted under the rules of [Arbitration Association] then in force. • Costs: The payment of filing, administration, and arbitrator fees will be governed by the [Arbitration Association]’s rules. Finage will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous.

8.3 No Class Actions You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.
